Australian Migration Program Introduction

Australia’s temporary visa programs allow people to come to Australia for a broad range of specific purposes (including to visit, study, working holidays and for international relations work) that deliver substantial economic and cultural benefits. The student visa and visitor visa programs are key enablers for Australia’s international education and tourism sectors, usually two of the largest export sectors.

A proportion of temporary visa holders apply for a further temporary visa while in Australia and some temporary visa holders also apply to stay permanently through the Migration Program. Some important visa subclasses in this category are:

Education and Training Visas

Student Visa Subclass 500 Visa

This student visa Australia is for those who want to study full time in Australia and their dependent family members.

Guardian Visa Subclass 590 Visa

The Guardian Subclass 590 visa is for those who want to accompany a student studying in Australia on Subclass 500 visa as a Guardian.

Recognised Graduate Subclass 476 Visa

The Subclass 476 visa is for Engineering Graduates who have completed their Qualification from a specified Institution within last 2 years.

Temporary Graduate Subclass 485 Visa

The Subclass 485 visa is for international students who have recently graduated with skills and qualifications that Australia needs.

Visitor Visa Subclass 600 Visa

The visitor subclass 600 visa is for tourists, business visitors or to visit family for 3, 6 or 12 months.

Medical Treatment Visa Subclass 602 Visa

The subclass 602 visa is for those who want to travel to Australia for medical treatment or to support someone needing medical treatment.

Sponsored Parent Visa Subclass 870 Visa

The sponsored parent subclass 870 visa lets a parent of an Australian Citizen or Permanent Resident visit Australia for up to 3 or 5 years.

Work and Holiday Subclass 417 Visa

This subclass 417 visa is for young adults from some countries to holiday in Australia, and work in Australia to fund those holidays.

Working Holiday Subclass 462 Visa

This subclass 462 visa is for young adults from some countries to holiday in Australia, and work in Australia to fund those holidays.

Family Migration and Visas

Partner Subclass 309 Visa

The Visa 309 allows the partner or spouse of an Australian citizen, Australian permanent resident or an eligible New Zealand citizen to live in Australia. You apply for the Partner (Temporary) Subclass 309 and Partner (Permanent) Subclass 100 visas together. You must be outside Australia when you apply for this visa.

Partner Subclass 100 Visa

This subclass 100 visa allows the partner or spouse of an Australian citizen, Australian permanent resident or an eligible New Zealand citizen to live in Australia. You apply for the Partner (Temporary) Subclass 309 and Partner (Permanent) Subclass 100 visas together. You must be outside Australia when you apply for this visa.

Partner Subclass 820 Visa

This partner subclass 820 visa allows the partner or spouse of an Australian citizen, Australian permanent resident or an eligible New Zealand citizen to live in Australia. You apply for the Partner (Temporary) Subclass 820 and Partner (Permanent) Subclass 801 visas together. You must be inside Australia when you apply for this visa.

Partner Subclass 801 Visa

This visa 801 allows the partner or spouse of an Australian citizen, Australian permanent resident or an eligible New Zealand citizen to live in Australia. You apply for the Partner (Temporary) Subclass 820 and Partner (Permanent) Subclass 801 visas together. You must be inside Australia when you apply for this visa.

Prospective Marriage Subclass 300 Visa

This prospective marriage visa 300 allows the partner or spouse of an Australian citizen, Australian permanent resident or an eligible New Zealand citizen to join their Australian citizen, Australian permanent resident or an eligible New Zealand citizen partner in Australia. This visa is applied by applicant's who are outside Australia at the time of application.

New Zealand Citizen Family Subclass 461 Visa

This visa 461 lets a spouse or partner or a member of the family unit of New Zealand Citizen who is resident in Australia, to live with their partner in Australia.

Child Subclass 101 Visa

The child subclass 101 visa lets a child outside Australia to move to Australia and live with their Australian Citizen or Permanent Resident parent in Australia. You need to be outside Australia at the time of the application.

Child Subclass 802 Visa

This subclass 802 visa lets a child inside Australia to stay and live with their Australian Citizen or Permanent Resident parent in Australia. You need to be inside Australia at the time of the application.

Child Adoption Subclass 102 Visa

This subclass 102 visa lets a child adopted outside Australia by an Australian Citizen or Permanent Resident to move to Australia to live with them permanently.

Orphan Relative Subclass 117 Visa

This subclass 117 visa lets a child who is single to come to Australia to live with a relative if their parents are dead, are unable to care for them or can't be found. You need to be outside Australia at the time of the application.

Orphan Relative Subclass 837 Visa

This subclass 837 visa lets a child who is single to stay in Australia to live with a relative if their parents are dead, are unable to care for them or can't be found. You need to be inside Australia at the time of the application.

Parent Subclass 103 Visa

This subclass 103 visa is parent permanent visa that lets a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen move to Australia. The applicant must be outside Australia while applying for this visa.

Aged Parent Subclass 804 Visa

This subclass 804 visa is permanent visa that lets an aged parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen move to Australia. The applicant must be inside Australia while applying for this visa.

Contributory Parent Subclass 173 Visa

This subclass 173 visa is a temporary visa that lets a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen move to Australia. The applicant must be outside Australia while applying for this visa.

Contributory Parent Subclass 143 Visa

This subclass 143 visa is a permanent visa that lets a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen stay in Australia. The applicant can be in or outside Australia while applying for this visa.

Contributory Aged Parent Subclass 884 Visa

This subclass 884 visa is a temporary visa that lets a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen move to Australia. The applicant must be outside Australia while applying for this visa.

Contributory Aged Parent Subclass 864 Visa

This subclass 864 visa is a permanent visa that lets a parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen stay in Australia. The applicant can be in or outside Australia while applying for this visa.

Aged Dependent Relative Subclass 114 Visa

This subclass 114 visa allows an aged dependent relative of an Australian Citizen or Permanent Resident to move to Australia permanently. The applicant must be outside Australia while applying for this visa.

Aged Dependent Relative Subclass 838 Visa

This subclass 838 visa allows an aged dependent relative of an Australian Citizen or Permanent Resident to stay in Australia permanently. The applicant must be inside Australia while applying for this visa.

Remaining Relative Subclass 115 Visa

This subclass 115 visa allows a remaining relative of an Australian Citizen or Permanent Resident to move to Australia permanently. The applicant must be outside Australia while applying for this visa.

Remaining Relative Subclass 835 Visa

This subclass 835 visa allows a remaining relative of an Australian Citizen or Permanent Resident to stay in Australia permanently. The applicant must be inside Australia while applying for this visa.

Carer Subclass 116 Visa

This subclass 116 visa allows a relative of an Australian Citizen or Permanent Resident to move to Australia permanently to take care of their relative with a medical condition. The applicant must be outside Australia while applying for this visa.

Carer Subclass 836 Visa

This subclass 836 visa allows a remaining relative of an Australian Citizen or Permanent Resident to stay in Australia permanently. The applicant must be inside Australia while applying for this visa.

General Skilled Migration Program

The Skill stream of the Migration Program is designed to meet Australia’s economic, demographic and labour market needs. It provides for the entry of migrants with higher than average labour force participation and productivity and specialist skills in demand in the labour market. Skilled migrants generate benefits for the economy by bringing to Australia new knowledge and skills, helping businesses take up new technology, and providing further connections to global markets. Specific skilled visas for regional Australia help to meet workforce shortages in designated regions.

General Skilled Migration is for skilled workers who do not have an employer sponsoring them but possess desirable skills and attributes and are able to pass the points test. This category includes the skilled independent and state and territory nominated visas:

Skilled Independent Subclass 189 Visa

This subclass 189 visa is for invited skilled workers to live and work permanently anywhere in Australia.

Skilled Nominated Subclass 190 Visa

This subclass 190 visa lets nominated skilled workers live and work in Australia as permanent residents.

Skilled Work Regional (Provisional) Subclass 491 Visa

This subclass 491 visa provisional visa for skilled people nominated by a state or territory government to live and work in regional Australia. This visa offers pathway to permanent residence through Subclass 191 visa.

Subclass Regional (Provisional) Subclass 489 Visa

This subclass 489 visa is closed to new applications. The only applications that can be made are Skilled Regional (Provisional) visa (Subclass 489) Extended stay pathway and Skilled Regional (Provisional) visa (Subclass 489) Subsequent entry pathway.

Skilled Regional (Permanent) Subclass 887 Visa

This subclass 887 visa is for people who have lived for at least 2 years and worked full time for at least 1 year in specified areas of regional Australia on a previous, eligible visa (Subclass 489, Subclass 495, Subclass 496, Subclass 475 or Subclass 487 visa).

Global Talent Subclass 858 Visa

This subclass 858 visa is for people who have an internationally recognised record of exceptional and outstanding achievement.

Employer Sponsored Migration

The program is designed to meet genuine skills shortage while not undercutting local employment, wages and conditions. The TSS visa enables employers to meet their workforce needs by bringing skilled workers from overseas where they cannot recruit an appropriately skilled Australian worker.

Employer Sponsored visas are for applicants who are sponsored by an employer. This category includes regional employer sponsored visas and visas granted under a Labour Agreement. Some important visa subclasses in this category are:

Temporary Skills Shortage Subclass 482 Visa

This subclass 482 visa lets an employer sponsor a skilled worker. This visa offers pathway to permanent residence through Subclass 186 visa.

Skilled Employer Sponsored Regional Subclass 494 Visa

This subclass 494 visa enables regional employers to address identified labour shortages in regional Australia. This visa offers pathway to permanent residence through Subclass 191 visa.

Employer Nomination Visa Subclass 186

This subclass 186 visa lets skilled workers live and work in Australia permanently.

Skilled Employer Sponsored Regional Subclass 191

This subclass 191 visa is Permanent Pathway for Subclass 491 and 494 visa holders.

Temporary Activity Subclass 408 Visa

This subclass 408 visa allows you to come to Australia to do specific types of work on a short-term, temporary basis such as Australian Government endorsed events, religious, social, cultural and/or research activities.

Business and Investment Visas

Business and Investment visas encourages successful business people to settle in Australia and develop new business opportunities. This category includes visas:

Business and Innovation Subclass 188 Visa

This subclass 188 visa allows you to own, manage, conduct business and investment activity in Australia.

Business and Innovation Subclass 888 Visa

This subclass 888 visa is for entrepreneurs, investors, and business owners on Subclass 188 pathway to Permanent Residence.

Business Talent Subclass 132 Visa

This subclass 132 visa is for experienced business owners or for those who have sourced venture capital funding from (AIC).

Refugee and Humanitarian Program

Australia's Refugee and Humanitarian Program helps people in humanitarian need and refugees who are:

  • Outside Australia, and need to resettle to Australia when they do not have any other solutions available; or
  • Already in Australia, and who want to seek protection after arriving in Australia.

Protection Subclass 866 Visa

A permanent Protection Subclass 866 visa allows the visa holder to live and work in Australia as a permanent resident. You must have arrived in Australia on a valid temporary visa.

Refugee Subclass 200 Visa

The Subclass 200 Visa is granted to those people who have been referred by the United Nations High Commissioner for Refugee (UNHCR) for settling in the country.

In-Country Special Humanitarian Subclass 201 Visa

This visa is for the individuals living in their home country, who are subject to persecution in their home country and face an immediate threat to their life.

Global Special Humanitarian Subclass 202 Visa

This visa is for individuals who are living outside their home country, and are subject to substantial discrimination amounting to gross violation of their human rights and have an Australian eligible sponsor.

Emergency Rescue Subclass 203 Visa

This visa is for a person who is subject to persecution in their home country and faces an immediate threat to their personal security and life.

Women at Risk Subclass 204 Visa

This visa is for a woman living outside her home country, is subject to persecution in that country, does not have the protection of a male relative and is in danger of victimisation, harassment or serious abuse because of her sex.

Relationship between Permanent and Temporary Migration

While Australia’s migration system does not offer automatic progression from temporary to permanent visas, a large number of permanent migrants use temporary visas as a pathway to gaining permanent residence.

Temporary visa holders who are in Australia are a major source of permanent Skill Stream visa applications, with a number of visas providing a pathway from temporary to permanent residence for those who have demonstrated their ability to contribute to the Australian economy.

Within the Skill Stream, the Employer Sponsored and Skilled Employer Sponsored Regional categories were most reliant on applications by Temporary Work visa holders while Graduate and Student visa holders comprised a significant proportion of grants for the State/Territory Nominated and Skilled Work Regional categories.
