Partner Visa allows the partner or spouse of an Australian citizen, Australian permanent resident or an eligible New Zealand citizen to live in Australia.

Partner visa is a two-stage process. In stage one you will be assessed for grant of provisional partner visa, and in stage two you will be assessed for the grant of permanent partner visa. Both applications are lodged at the same time when you apply for partner visa. However, stage 2 processing will start when two years has lapsed since the partner visa application was lodged.

For individuals who have a partner who is an Australian citizen, permanent resident, or eligible New Zealand citizen, there are several partner visa options available. These visas provide opportunities for couples to be together in Australia and may eventually lead to permanent residency.

Offshore Partner Visa if you are outside Australia while applying

If you are outside Australia while applying for the partner visa, then you will lodge the following visas:

Partner (Provisional) (Class UF) Subclass 309 Visa

This Partner Subclass 309 Visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to move to Australia temporarily. You must be outside Australia when you apply for this offshore partner visa.

Partner (Migrant) (Class BC) Subclass 100 Visa

This Partner Subclass 100 Visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently. Usually, 2 years must have passed since you applied for the combined Subclass 309 and Subclass 100 visa for you to be assessed for the permanent visa. You must be outside Australia when you apply for this visa.

Onshore Partner Visa if you are inside Australia while applying

If you are inside Australia while applying for the partner visa, then you will lodge the following visas:

Partner (Temporary) (Class UK) Subclass 820 visa

This Partner Subclass 820 visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen stay in Australia temporarily. Getting this visa is the first step towards a permanent residence Partner visa (subclass 801). Usually, 2 years must have passed since you applied for the combined visa 820 and 801 for you to be assessed for the permanent visa. You must be inside Australia when you apply for this visa.

Partner (Permanent) (Class BS) Subclass 801 visa

This Partner Subclass 801 visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia permanently. This visa is the second step towards a permanent residency after Partner visa subclass 820.

If you want to travel to Australia to get married to your partner

Prospective Marriage (Temporary) (Class TO) Subclass 300 Visa

This Prospective Marriage Subclass 300 Visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to join their Australian citizen or Australian permanent resident partner to marry.  You must be outside Australia when you apply for this visa, and intend to marry your prospective spouse before the visa period ends. The visa period will be between 9 and 15 months from the date of visa grant.
