Subclass 408 Visa Streams

408 Visa can be lodged under one of the following streams: Australian Government Endorsed Events, Special Program, Religious Work, Research Activities, Invited for other Social and Cultural Activity (Invited Participant), Sporting Activities, Entertainment Activities, Superyacht Crew, Exchange Arrangements and Domestic Work for Executives.

Including Family Members

If you have spouse/partner and kids, they can also be included in your Subclass 408 visa application before or after a visa is granted.

Visa Holders Work Rights in Australia

The visa holders will have full work rights in Australia and must continue to work with their nominating employer.

Subclass 408 Visa for Australian Government Endorsed Events Stream

This temporary visa lets you come to Australia to participate in events which are endorsed by the Australian Government such as COVID-19 Pandemic Event, Post COVID-19 Economic Recovery Event, and Supporting Innovation in South Australia Event.

COVID-19 Pandemic Event

- Remain in Australia for 12 months if you are working or have a job offer to work in the following key sectors: agriculture, food processing, health care, aged care, disability care, child care, and tourism and hospitality.- remain in Australia for 12 months if you are working for or have a job offer from a Commonwealth funded aged care service.
- Remain in Australia for 6 months if you are working or have a job offer to work in any other sector in Australia.
- Include members of the family unit in your application.
If you are a visitor to Australia with no work rights and cannot support yourself, you should make arrangements to return home. If you apply on or after 21 February 2022, you will no longer be eligible for this visa on the grounds of being unable to depart Australia due to COVID-19 travel restrictions.

Post COVID-19 Economic Recovery Event

You must provide a letter of endorsement from your employer to take part in the Post Covid-19 Economic Recovery event. The letter must provide the following details:
- a statement by your employer that they are receiving coordinated facilitation to relocate to Australia from the Global Business and Talent Attraction Task force.
- if the business owner has made a Global Talent visa application you must provide the Transaction Reference Number (TRN) or equivalent for the owner’s application.
- your employment history with your employer and why you are a key member of staff required to assist with the relocation of the business to Australia.
- your remuneration package, and how this remuneration meets or exceeds the Annual Market Salary Rate for your occupation in Australia.

Supporting Innovation in South Australia Event

Letter of Endorsement: You must have a letter of endorsement from the South Australian Government to take part in Supporting Innovation in South Australia.
Supporting Business Plan: If you are an entrepreneur participating in Supporting Innovation in South Australia, you must attach a copy of the supporting business plan that you provided to the South Australian Government to the visa application.
Proof of Vocational English: If you are an entrepreneur participating in Supporting Innovation in South Australia event, you must attach proof that you meet Vocational English requirements to the visa application.

This visa lets you stay in Australia to take part in an approved special programs such as youth exchange, cultural enrichment or community programs, school language assistants or gap year school volunteering.

Take part in an Approved Special Program

You must be travelling to Australia to take part in an approved special program. There are 4 types of special programs: cultural enrichment or community benefit programs, youth exchange programs, school language assistance programs or school-to-school interchange programs.
Be here for Cultural Exchange: The main purpose of the program you take part in should be cultural exchange. You should be here to share cultural and social experiences and knowledge by taking part in the program.
Have a Supporter or Sponsor: You don't need a sponsor to apply for this visa if you apply outside Australia, and intend to stay for less than 3 months. You must have a supporter to apply for this visa. You need a sponsor if You apply for this visa in Australia, or apply outside Australia and intend to stay for more than 3 months.

Be here for Cultural Exchange

The main purpose of the program you take part in should be cultural exchange. You should be here to share cultural and social experiences and knowledge by taking part in the program.

Have a Supporter or Sponsor

You don't need a sponsor to apply for this visa if you apply outside Australia, and intend to stay for less than 3 months. You must have a supporter to apply for this visa. You need a sponsor if You apply for this visa in Australia, or apply outside Australia and intend to stay for more than 3 months.

Be invited For Academic Research Activities for 408 visa

You must be invited to observe or participate in an Australian research project at an Australian tertiary or research institution, usually in collaboration with other academics employed there.

Be invited For For Research Student Activities

You must be invited to undertake research related to your field of study at an Australian tertiary or research institution.

Have a supporter or sponsor

You don't need a sponsor to apply for this visa if you apply outside Australia, and intend to stay in Australia for less than 3 months. However, you must have a supporter to apply for this visa.
You need a sponsor to apply for this visa if you apply in Australia, or apply outside Australia, and intend to stay for more than 3 months.

Be an established Academic Researcher, Research Student or Recent Graduate Researcher

To be eligible for this activity type, you must be or have been employed as an academic at an overseas tertiary or research institution, and have a record of significant achievement in your field.

Research Student or Recent Graduate

To be eligible for this activity type you must be a student of a foreign educational institution or have graduated within the last 12 months, and invited to undertake research related to your field of study.

Be invited For For Research Student Activities

You must be invited to undertake research related to your field of study at an Australian tertiary or research institution. If you have not yet graduated, you must be undertaking the research to meet course requirements for your overseas qualification.

Be able to support yourself and any dependants

You must have enough money to support yourself during your stay in Australia and any dependent family members who travel to Australia with you.

Subclass 408 Visa Invited for other Social and Cultural Activity Stream

Be invited to take part in a social or cultural community activity

You must be invited to travel to Australia temporarily by an Australian organisation to take part in a social or cultural activity associated with a community-based event.

Have a supporter or sponsor

You don't need a sponsor to apply for this visa if you apply outside Australia, and intend to stay for less then 3 months. You must have a supporter to apply for this visa. You need a sponsor to apply for this visa if you in apply in Australia.

Be able to support yourself and any dependants

You must have access to enough money during your stay in Australia to support yourself and any dependent family members who travel with you.

Have adequate health insurance

You are personally liable for all your healthcare costs while you are in Australia. Medical insurance helps limit your financial liability. You must have adequate health cover for the whole of your stay to be granted this visa. Your cover should cover you for medically necessary treatment, including transport.

Have paid debt to Australian Government

If you owe the Australian Government money, you must have paid it back or have a formal arrangement to pay it back.

Declare you have not paid for visa sponsorship

Apply as a Sports Trainee

You must be able to show you currently compete or adjudicate at the Australian national level (or equivalent); or be endorsed by a relevant peak sporting body as having the potential to compete or adjudicate at the Australian national level (or equivalent).

Apply as an Elite Player, Coach, Instructor or Adjudicator

You must have an established reputation in your sporting field if you apply as: an elite player, a coach, an instructor, an adjudicator. You must be endorsed by an Australian national sporting body as being able to play, coach, instruct or adjudicate the sport at a national level.

Take part in full-time structured sports training (if applicable)

You must be undertaking full-time, structured sports training aimed at achieving a high performance outcome with an internationally recognised sports training organisation if you apply for this visa as a sports trainee.

Have a supporter or sponsor

You don't need a sponsor to apply for this visa if you apply outside Australia, and intend to stay for less then 3 months. You must have a supporter to apply for this visa. You need a sponsor to apply for this visa if you in apply in Australia.

Have a suitable formal agreement (if applicable)

You must have a suitable formal agreement with your sporting club or sporting organisation in Australia if you apply for this visa as: an elite player, a coach, an instructor, and an adjudicator.

Subclass 408 Visa Entertainment Activities Stream

Have a contract or other proof of your activity in Australia

You must have a contract for your performance or work in Australia. If you are here for a non-profit engagement, whether as a performer or production staff, you must be able to show 'Home Affairs' evidence of this. If you are here to make an advertisement or documentary for an overseas market, you must be able to show 'Home Affairs' evidence of this such as a distribution contract.

Intend to work in an eligible entertainment activity category

You apply for this visa under one of these categories:
- Performing in a film or television production subsidised by government;
- Performing in a film or television production not subsidised by government;
- Performing other than in film or television;
- Working as production staff;
- Working as support staff for an entertainer or group of entertainers;
- Working as a performer or support staff for a non-profit engagement;
- Working on a documentary or commercial for an overseas market.

Have paid back debt to the Australian government

If you owe the Australian Government money, you must have paid it back or have a formal arrangement to pay it back.

Sign the Australian values statement

If you are 18 years of age or older, you must acknowledge the Australian Values Statement that confirms you will respect the Australian way of life and obey Australian laws.​

Subclass 408 Visa Superyacht Crew Stream

Have an employment contract or letter confirming employment

You must have a contract to work as a crew member on a superyacht in Australia, or a letter confirming your employment as a crew member on a superyacht in Australia.

Eligible categories of Superyacht

A superyacht is a high-value luxury sailing or motor vessel that is 24 metres or longer; and doesn't carry cargo; and is used for sport or recreation.

Have a supporter or sponsor

You don't need a sponsor to apply for this visa if you apply outside Australia, and intend to stay for less then 3 months. You must have a supporter to apply for this visa. You need a sponsor to apply for this visa if you in apply in Australia.

Be able to support yourself

Meet the support test: To meet the support test you will need to provide a letter of invitation, on your organisation's letterhead if it has one; and the 'Department of Home Affairs' (Home Affairs) must not be aware of any adverse information about you or anyone associated with you that would affect your suitability as a supporter.
Provide Letter of Invitation: The letter of invitation must identify the visa applicant and any family members; and the work the applicant will do; and what the applicant's duties will be; and when and where the applicant will be working. You don't need to submit an application to be a supporter.
Be a certain kind of organisation: You must be the owner, operator or captain of a superyacht. You must be able to provide evidence of superyacht status.

Sponsor Eligibility

Meet the sponsorship test: You must be an approved temporary activities sponsor to sponsor an applicant for this visa. Take part in a reciprocal staff exchange

You must intend to work in a skilled position as part of a reciprocal staff exchange arrangement with an eligible organisation in Australia. There must be a written agreement between your organisation and the organisation in Australia that sets out: the staff in Australia and overseas who will take part in the exchange; and the skilled positions to be filled by the participants; and how long the exchange will last.

Have the necessary skills and experience for the position

You must have the necessary skills and/or experience to perform the skilled position set out in the exchange agreement.

Benefit from the exchange

The exchange arrangement must benefit both you and the Australian citizen or permanent resident taking part.

Be able to support yourself and any dependants

You must have enough money to support yourself and any dependent family members who travel to Australia with you.

Be invited to work

You must be invited to work full-time in the household of a senior foreign executive.

Senior Foreign Executive

For this subclass 408 visa activity, a senior foreign executive is: the holder of a Temporary Work (International Relations) visa (subclass 403) Privileges and Immunities stream, who is the national managing director, deputy national managing director or state manager of the sponsor's Australian office; or the holder of a Temporary Work (Skilled) visa (subclass 457) or a Temporary Skill Shortage visa (subclass 482) who is the national managing director, deputy national managing director or state manager of the sponsor's Australian office.

Subclass 408 Visa Conditions

Condition 8106 - Work limitation

You cannot work in Australia unless it is relevant to the business or tasks specified in the visa application.

Condition 8107 - Work limitation

The visa you hold was granted to either allow you to be employed by a particular employer, or to undertake specific activities in Australia. You must not stop working for your employer. You must not work in a different position, occupation or with another employer or for yourself.

Condition 8114 - Superyacht crew

You can only work in Australia as a member of the crew of a superyacht.

Condition 8301 - Meet any outstanding public interest criteria

You must satisfy outstanding public interest criteria after you enter Australia and before the visa ceases.

Condition 8303 - Not be disruptive

You must not become involved in activities disruptive to, or violence threatening harm to, the Australian community or a group within the Australian community.

Condition 8501 - Maintain adequate health insurance

You must have and maintain adequate health insurance for the whole of your stay in Australia.

Condition 8502 - Not arrive before person specified in visa

You must not enter Australia before the person specified in the visa has entered Australia. This is usually the main visa holder or other relevant person such as your sponsor in the case of a Partner visa.

Condition 8526 - Let Home Affairs know where you are living in Australia

You must notify the Department in writing of your place of residence in Australia, 7 days before the visa ceases. You must post the notification to the Central Office of Immigration in the Australian Capital Territory.
