Subclass 491 Visa Tasmania

State Nomination from Tasmania for Skilled Regional (Provisional) Subclass 491 visa provides you with fifteen additional points towards meeting the Department of Home Affairs skilled visa points test pass mark of 65 points, and will let you live and work in Tasmania for up to 5 years.

Tasmania 491 Requirements

To be eligible for subclass 491 state nomination from Tasmania, you must meet the following requirements set out by the Department of Home Affairs for 'Skilled Regional (Provisional) Subclass 491 Visa'.

You must have:

  • Not yet turned 45 years of age.
  • Nominated an occupation on the relevant list of eligible skilled occupations.
  • A valid and positive skills assessment for your nominated occupation.
  • At least ‘Competent’ English language proficiency.
  • At least 65 points on the Department of Home Affairs points test.

You will also need to meet the Tasmanian Government nomination requirements for subclass 491 nomination to be eligible for state nomination. There are different nomination pathways and each has different requirements and priority attributes that will determine your pass mark. Details of minimum requirements and priority attributes for each nomination pathway are as follows:

Subclass 491 Tasmanian Skilled Employment Pathway

For skilled migrants who have worked in Tasmania for at least the last 6 months with a skills assessment and occupation that is not on the Tasmanian Onshore Skilled Occupation List (TOSOL):

Minimum Requirements

If you are working in a role classified as Skill Level 1 – 3 according to ANZSCO

  • You must have been working in Tasmania for at least six months immediately prior to your application. Your employment must average at least 20 hours per week over the six-month period immediately prior to lodging your application.
  • If you have a skills assessment and related employment in an occupation listed on the Tasmanian Onshore Skilled Occupation List (TOSOL ) – you may be eligible for nomination after three months of employment.
  • You must currently be living in Tasmania and intend to continue living in Tasmania (your dependents must not be living in another Australian state or territory).
  • Your employment does not need to be related to your skills assessment.
  • There must be a genuine, ongoing need for your position within the business (including a minimum 12-month contract with at least three months remaining at the time you apply for nomination).
  • If you are a subcontractor, you may be considered in this pathway if you have a related skills assessment and at least 12 months business activity in Tasmania.
  • If your employment is not related to your skills-assessment you must have relevant qualifications or experience consistent with the ANZSCO definition for that role.

If you are working in a role classified at ANZSCO Skill Level 4 or 5

  • You must have been working in Tasmania for at least six months (12 months for applications made in the 2023-24 program year) immediately prior to your application. Your employment must average at least 20 hours per week over the 12-month period prior to lodging your application
  • You must currently be living in Tasmania and intend to continue living in Tasmania (your dependents must not be living in another Australian state or territory).
  • Your employment must be ongoing, for at least six months beyond the application date.
  • There must be a genuine and demonstrated severe labour recruitment difficulty for the role, endorsed by your employer in a statement detailing the need for the position, local recruitment and workforce development activities and strategies in place that have attempted to address that recruitment difficulty.
  • You must have relevant qualifications or experience consistent with the ANZSCO definition for that role (see “additional details and definitions”).
  • There must be opportunities for career advancement, endorsed in writing by your employer

Candidates who have only six months work experience in their ANZSCO 4 or 5 role are unlikely to be successful without possessing additional priority attributes.

Employment and Conditions

  • Your employer must be a well-established business that has been actively operating in Tasmania for the past 12 months.
  • Your wages and conditions must be no less favorable than those that would apply to an Australian citizen or permanent resident, and salary or wages are at least equivalent to the market salary rate.
  • There must be a genuine, ongoing need for your position within the business (including a minimum 12 month contract with at least three months remaining at the time you apply for nomination). The contract may be casual, but must comply with the Fair Work Ombudsman’s National Employment Standards.

Priority Attributes

The following attributes are used to rank Registrations of Interest. Only the most competitive candidates are invited to apply for nomination. To qualify for gold or green priority attributes, employment must be skilled (ANZSCO 1-3).

Gold

  • You have a skills assessment and directly related employment for at least the past 3 months included in the critical roles list.

Green

  • You have been employed in Tasmania for more than 2 years in a skilled role (ANZSCO 1-3) directly related to your skills assessment.
  • You have been employed in Tasmania for at least the last 6 months in an area directly related to your skills assessment.

Orange

  • You have been employed in Tasmania for the past 9-12 months in an ANZSCO 1-3 role in the same industry area as your skills assessment.
  • You have been employed in Tasmania for the past 12 months in an ANZSCO 1-3 role in the same industry area as your skills assessment.
  • You have been employed in Tasmania for more than 18 months in an ANZSCO 1-3 role which is not directly related to your skills assessment.
  • You are employed in ANZSCO 4-5 role and hold a qualification related to this role (minimum Certificate III, not including online courses or qualifications gained on the basis of Recognition of Prior Learning).
  • You speak Proficient / Superior English, or you have an exemption to the English language requirements based on your passport country.
  • You are currently paid a base salary of at least $53,900 per year or 27.64 per hour (excluding overtime or casual loadings).
  • You are currently paid a base salary of at least $62,000 per year or $31.79 per hour (excluding overtime or casual loading).
  • You are currently paid a base salary of at least $90,617 per year or $42.62 per hour (excluding overtime or casual loading).
  • You have lived in Tasmania for at least the past 2 years.
  • You have lived in Tasmania for at least the past 3 years.
  • Your spouse is employed in skilled role (ANZSCO 1-3) or has been running a business in Tasmania for the past 6 months.
  • Your spouse has completed a minimum AQF 6qualification with a Tasmanian education provider in Tasmania.
  • Your spouse has lived in Tasmania for at least the last 6 months.
  • You have close family living in Tasmania including siblings, parents, aunts, uncles, nieces, nephews, cousins or grandparents.

Tasmanian Skilled Graduate Pathway

For Tasmanian Graduates who have completed at least one year of full-time study with a Tasmanian CRICOS registered education provider.

Minimum Requirements

  • You must have completed a course of study and obtained a letter of completion from a tertiary institution in Tasmania registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS).
  • You must have lived in the state for at least one calendar year from the commencement of your course and for the duration of your studies.
  • Your course of study must be AQF 5 (Diploma) or higher, or at least Certificate III related to an ANZSCO Major Group 3 or Group 4 occupation, and be listed on CRICOS with a duration of at least 40 weeks.
  • Your course must have been completed full-time and on-site in Tasmania.
  • You must currently be living in Tasmania and intend to continue living in Tasmania.

Priority Attributes

The following attributes are used to rank Registrations of Interest. Only the most competitive candidates are invited to apply for nomination.   • You have operated a Tasmanian business for at least 6 months which is directly related to your skills assessment or area of study.
  • You have an offer for a graduate employment program. (Must be full-time, received before graduation, related to your skills assessment and be from a medium or large Tasmanian business that has been operating in Tasmania for more than 5 years. The medium to large business is one with at least 20 employees (e.g. Deloitte, Taswater).

Orange

  • You have been employed in Tasmania for at least the last 6 weeks in the same industry as your skills assessment or Tasmanian study.
  • You have been employed in Tasmania for at least the last 3 months in an ANZSCO 1-3 role which is not related to your skills assessment.
  • You are employed in an ANZSCO 4-5 role and have a qualification related to this role (minimum Certificate III, not including online courses or qualifications gained on the basis of Recognition of Prior Learning).
  • You have evidence of job interviews with at least 2 well-established businesses that have been operating in Tasmania for at least 3 years for positions that are related to your skills assessment or study.
  • You are currently paid a base salary of at least $53 900 per year or 27.64 per hour (excluding overtime or casual loadings).
  • You are currently paid a base salary of at least $62 000 per year or $31.79 per hour (excluding overtime or casual loading).
  • You are currently paid a base salary of at least $90 617 per year or $42.62 per hour (excluding overtime or casual loading).
  • You have completed an in-course work placement of at least 400 hours (e.g., nursing, teaching, medicine, social work).
  • Your Tasmanian study is directly related to an occupation on the critical roles list.
  • You have commenced PhD studies in Tasmanian after completing undergraduate or postgraduate study in Tasmania.
  • You have lived in Tasmania for over 4 years.
  • You have not lived or studied in another part of Australia.
  • You speak Proficient / Superior English, or you have an exemption to the English language requirements based on your passport country.
  • Your spouse is employed in skilled role (ANZSCO 1-3) or has been running a business in Tasmania for the past 6 months.
  • Your spouse has completed a minimum AQF 6 qualification with a Tasmanian education provider in Tasmania.
  • Your spouse has lived in Tasmania for at least the last 6 months.
  • You have close family living in Tasmania including siblings, parents, aunts, uncles, nieces, nephews, cousins or grandparents.

Tasmanian Established Resident Pathway

For skilled migrants who are employed and have lived in Tasmania home for at least the last 2 years.

Minimum Requirements

You must have been living in Tasmania for at least two years (with no more than 50 per cent of total Australian residence period spent in another Australian state or territory) and currently be employed in Tasmania in either:

  • a role equivalent to ANZSCO Skill Level 1-3, including a cumulative six months experience at the same level in the last 12 months (a minimum 20 hours per week), or
  • a role equivalent to ANZSCO Skill Level Skill Level 4 or 5, with a cumulative 12 months experience at the same level or higher in the last 18 months (a minimum 20 hours per week).

Priority Attributes

The following attributes are used to rank Registrations of Interest. Only the most competitive candidates are invited to apply for nomination. To qualify for gold or green priority attributes, employment must be skilled (ANZSCO 1-3). Check the TOSOL for any caveats that may apply to your occupation.   • You have been employed  in Tasmanian for at least the last  12 months in an ANZSCO 1-3 role in Tasmania which is not related to your skill assessment.
  • You have a qualification related to your current employment role (minimum Certificate III, not including online courses or qualifications gained on the basis of Recognition of Prior Learning).
  • You have two years’ prior Australian industry experience relevant to your current employment.
  • Your current employer has been operating in Tasmania for at least 5 years.
  • You have resided in Tasmania continuously for more than 4 years.
  • You have resided in Tasmania continuously for more than 5 years.
  • You are currently paid a base salary of at least $53 900 per year or 27.64 per hour (excluding overtime or casual loadings).
  • You are currently paid a base salary of at least $62 000 per year or $31.79 per hour (excluding overtime or casual loading).
  • You are currently paid a base salary of at least $90 617 per year or $42.62 per hour (excluding overtime or casual loading).
  • You speak Proficient / Superior English, or you have an exemption to the English language requirements based on your passport country.
  • Your spouse is employed in skilled role (ANZSCO 1-3) or has been running a business in Tasmania for the past 6 months.
  • Your spouse has completed a minimum AQF 6 qualification with a Tasmanian education provider in Tasmania.
  • Your spouse has lived in Tasmania for at least the last 6 months.
  • You have close family living in Tasmania including siblings, parents, aunts, uncles, nieces, nephews, cousins or grandparents.

Tasmanian Business Operator Pathway

For skilled Migrants who have successfully established and operated a business in Tasmania for at least 12 months.

Minimum Requirements

  • You must demonstrate that you have established and operated a business (solely owned or co-owned with spouse) in Tasmania for at least 12 months. If you began operating your business before 15 April 2022 you must have operated your business for at least six months immediately prior to your application.
  • Your business must have provided a personal taxable income to you of at least 85 per cent of the Temporary Skilled Migration Income Threshold (i.e. currently $45,815).
  • You must show that you have an understanding of the responsibilities and requirements around treating employees fairly by completing key units on the Fair Work Ombudsman’s online learning centre.
  • Owners of massage therapy businesses must have a related skills assessment and the business must be in a hospital, aged or disability care setting or an allied healthcare setting such as a physiotherapy clinic.
  • Subcontracting business owners are not eligible for consideration in this pathway.

Priority Attributes

  • You have a qualification related to current business activities (minimum Certificate III, not including online courses or qualifications gained on the basis of Recognition of Prior Learning).
  • You have a skills assessment related to current business activities.
  • You have operated your business in Tasmania for more than 18 consecutive months.
  • You employ at least 3 full time employees who are Australian citizens or permanent residents or provisional visa holders.
  • You have resided in Tasmania for more than 2 years.
  • You have resided in Tasmania for more than 3 years.
  • You have earnings from your business higher than $53 900 per year, or $27.64 per hour.
  • You have earnings from your business higher than $62,000 per year or $31.79 per hour.
  • You have earnings from your business higher than $90 617 per year (excluding overtime) or $42.62 per hour).
  • You speak Proficient / Superior English, or you have an exemption to the English language requirements based on your passport country.
  • Your spouse is employed in a skilled role (ANZSCO 1-3) or has been running a business in Tasmania for the past 6 months.
  • Your spouse has completed a minimum AQF 6 qualification with a Tasmanian education provider in Tasmania.
  • Your spouse has lived in Tasmania for at least the last 6 months.
  • You have close family living in Tasmania including siblings, parents, aunts, uncles, nieces, nephews, cousins or grandparents.

Overseas Applicant (Job Offer) Pathway

For skilled migrants living outside Australia who have received a job offer in Tasmania that is closely related to their skills assessment. To be considered for this pathway you must meet all the criteria below, including the Gold priority attribute.

Minimum Requirements

You must have received a formal job offer for a job that is based in Tasmania that is closely related to your nominated occupation.
You, or any of your dependents must not have lived in another Australian state or territory within the last 12 months.
Your employer must have a well-established business that has been actively operating in Tasmania for at least the past 12 months.
Your wages and conditions must be no less favorable than those that would apply to an Australian citizen or permanent resident, and salary or wages must be at least equivalent to the local market salary rate.
There must be a genuine and ongoing need for your position within the business and the capacity for the business to sustain your employment.
Massage therapist positions must be located in a hospital, aged or disability care setting or an allied healthcare setting such as a physiotherapy clinic.

Job offer from well-established Tasmanian business directly related to skills assessment.

Overseas Applicant (OSOP) - Invitation Only Pathway

For skilled migrants living outside Australia who have an occupation listed on the Overseas Skilled Occupation Profile (OSOP) and have received a Skill Select invitation from Migration Tasmania.

Minimum Requirements

  • Migration Tasmania has contacted you in writing asking you to register on the Migration Tasmania Gateway (you will not be eligible for nomination if you have not first been contacted by Migration Tasmania).
  • Your nominated occupation must be listed in the Overseas Skilled Occupation Profiles.
  • You, or any of your dependents, must not have lived in another Australian state or territory within the last twelve months.
  • You must have access to sufficient financial assets to fund your migration and settlement in Tasmania for at least six months while you seek employment.
  • If invited to apply for nomination you must provide evidence of contact with at least two Tasmanian employers who have been operating in Tasmania for at least 12 months. This should express the employer’s interest in discussing employment opportunities with you. See document checklist for details of what this look like.
  • If invited to apply for nomination you must provide personal research into recent advertised positions relevant to your nominated occupation (a minimum of two vacancies no older than six weeks before you apply for nomination).
  • You must provide an employment statement for each advertisement explaining how your qualifications, knowledge and experience relate to and meet the requirements for each of the job advertisements.
